Decision No. (75) (2008) with regard to settlement procedure and enforcement of crimes committed violating the labour market regulation act

The Minister of Labour, Chairman of Board of Directors of Labour Market Regulatory Authority:
After Perusal of Legislative Decree No (15) (1976) and Amendments With Regard to the Promulgation of the Penal Code,
And Act No (19) (2006) with Regard to the Labour Market Regulations, and in Particular Articles (23) and (40),
And Decree No (75) With Regard to the Formation of the Board of Directors of Labour Market Regulatory Authority,
And upon the Presentation of the Deputy Chief Executive Officer, the Acting Chief Executive, of Labour Market Regulatory Authority,
And after obtaining the Consent of the Board of Directors of Labour Market Regulatory Authority,
Decided as follows:
Article (1)
In the implementation of this decision, unless the context otherwise requires, the following words and phrases shall have the corresponding meanings:
Authority: Labour Market Regulatory Authority.
Chief Executive: the Chief Executive Officer of Labour Market Regulatory Authority.
Employer: The employer as defined in the corresponding meaning in Article (1) of Act No (19) (2006) with Regard to Labour Market Regulation.
Authority Inspector: The employee of the Inspection Department of the Authority, empowered to conduct inspection, and who is an authorized legal enforcement officer.
Prescribed Fine: the minimum limit specified for the fine stated in Article (36) (A) of Act No (19) (2006) with Regard to Labour Market Regulation.
Article (2)
The crime of employment of a foreign worker without the issuance of a work visa in accordance with the labour Market Regulation Act, or the employment of such worker in violation of the law, or in violation of the conditions of the work visa , shall be subject to settlement save in cases of habitual offenders.
Article (3)
If the violator is desirous to conclude a settlement, a separate record shall be prepared, for that purpose.
The violator and the Authority’s inspector shall give their signature on the record which shall be approved by the Director of the inspection department.
Article (4)
The prescribed fine shall be paid in cash, certified cheque, or visa accepted by the Authority, provided that the amount of fine is not paid in installments.
Article (5)
The Chief Executive of the Authority shall implement this decision which shall come in force on the second day subsequent to publication in the gazette.
